Terms and Conditions for Use of the Application
The present Terms and Conditions represent a binding agreement between the user and “Bono Georgia“ LLC (ID: 402261299) (hereinafter referred to as the “Company”). It regulates the use of the Bono application platform and sets out standards for collecting/storing User Personal Data by the company.
This Agreement shall be deemed concluded upon the expression of electronic consent by the user.
Article 1. Introduction
1.1 This document (hereinafter referred to as the “Agreement”) outlines the terms and conditions for using the application “Bono App” provided by LLC “Bono Georgia” (hereinafter referred to as the “Company”). It defines the description of the products, services, and features available within the application, as well as the rights and obligations of the parties during the use of the application, along with other provisions important for the user’s interaction with Bono App.
1.2 This Agreement constitutes a legally binding agreement between the user and the Company and governs the user’s use of the application’s platform, as well as the Company’s standards for collecting, storing, and processing the user’s personal data.
1.3 This Agreement is deemed concluded upon the user’s expression of electronic consent.
Article 2. Definitions
2.1 Agreement – These terms and conditions.
2.2 Application – “Bono App”, a mobile application for smartphones.
2.3 Company – The owner of the “Bono App”, LLC “Bono Georgia”.
2.4 Partner Company – An individual legal entity that shares user data from its own loyalty system (accumulated/spent points) with LLC “Digital System Georgia” for the purpose of displaying those points in the application.
2.5 Electronic Wallet – An electronic money account registered in the name of the user, accessible through the Bono App, which allows the use of electronic funds in the manner defined by this Agreement.
2.6 User – A natural person authorized to use the application under this Agreement.
2.7 Registration – The completion of required personal data fields in the application by the user for the purpose of spending accumulated points.
2.8 Personal Data – The user’s personal data required for registration in the application: first name, last name, date of birth, personal ID number, and mobile phone number.
2.9 Registered Verified User – A user who has filled out all required fields during registration and has completed mobile number verification.
2.10 Unregistered User – A user who has not registered in the application but accumulates points via a QR code generated by the app.
2.11 Recognized User – A user who has completed verification in the application and whose data fully matches the data held by the partner company/companies.
2.12 Unrecognized User – A user who has completed verification, but some of their data does not match the data in the partner company/companies’ systems.
2.13 Additional Identification – In the case of an unrecognized user, the process of uploading a photo of themselves holding a personal identification document for identity verification.
2.14 One-Time Code – A code sent to the mobile number provided during registration, which must be entered to complete registration and verify the user.
2.15 Active Account – A user account where point accumulation is active.
2.16 Passive Account – A user account where point accumulation has been suspended for some reason.
2.17 Point – A non-monetary promotional unit accumulated by the user for any purchase made at a partner company within the application’s system.
2.18 QR Code – A unique barcode used in the application to accumulate/spend points and/or electronic money, perform top-ups, and execute other transactions (also used for identifying users or merchants).
2.19 Statement – Information on the operations and balances in the user’s account over a specific time period.
2.20 Point Accounting – Accumulation of points via the application’s QR code and aggregation of data provided by partner companies.
2.21 Catalog – A section of the application where options for spending points are presented.
2.22 Point Redemption – The purchase of various products/services using points available in the application.
2.23 Open Banking – The immediate sharing of a user’s personal data across different financial institutions at the user’s initiative, using electronic technologies.
Article 3. General Rules
3.1 The application may only be used by an adult natural person who is a citizen of Georgia.
3.2 Upon first opening the application, the user is presented with the terms and conditions of use, which must be accepted in order to use the application. Acceptance is considered equivalent to signing this Agreement.
3.3 During registration, the user must complete the required fields, including: first name, last name, date of birth, personal identification number, and mobile phone number.
3.4 By entering the one-time code sent to the provided mobile number during registration, the user confirms that the mobile number belongs to them.
3.5 By agreeing to this Agreement, the user confirms that the information entered during registration is personal, accurate, and truthful.
3.6 The user is responsible for any undesirable consequences resulting from entering incorrect or third-party information.
3.7 The Company is not responsible for any undesirable outcomes caused by the entry of incorrect data or failure to update the data.
3.8 By agreeing to this Agreement, the user authorizes the Company to:
3.8.1Unilaterally modify the rules and/or conditions outlined in this Agreement at any time to comply with applicable regulatory laws;
3.8.2Share the user’s registration data, transaction history, and point balance, as well as any other necessary data, with partner companies for data exchange, personalized offers, and statistical purposes. Partner companies include: LLC “Aversi-Pharma”, JSC “Elit Electronics”, LLC “Amboli”, and LLC “Miniso Georgia”; The complete list of partner companies is available in the ‘Where to Collect’ section of the application.
3.8.3In the event of subsequent point changes, share the related data and transaction information/receipts with partner companies;
3.8.4Exchange non-personalized information with partners;
3.8.5Provide personalized offers to the user via Bono, partner companies, and through the Bono app and the social media accounts of Bono and its partners;
3.8.6Offer the user the opportunity to join the loyalty programs of partner companies they are not yet registered with. If interested, the user may review the partner company’s loyalty program Terms and Conditions, Privacy Policy, and Direct Marketing Terms within the application. Upon consent, the Company is authorized to share the user’s personal data with the respective partner company.
3.9 After agreeing to the terms and conditions, the user may use the application’s point accumulation system without registering—as an unregistered user.
3.10 To redeem points, the user must complete registration and obtain the status of a registered verified user.
3.11 An unrecognized user must complete additional identification in order to obtain registered verified user status.
3.12 Upon successful additional identification and with the partner company’s consent, the user’s points accumulated at the partner company will be reflected in the application.
3.13 If the user disagrees with the displayed point balance, they are entitled to contact the application’s hotline to request a data review.
3.14 The user has the right to request account deletion. Upon such a request, all accumulated points will be reset. The Company is obligated to delete the user’s account and personal data within two (2) business days of the request.
3.15 The Company is authorized to temporarily suspend services during technical disruptions or force majeure events until the issues are resolved.
Article 4. Point Accumulation Rules
4.1 Users have the opportunity to accumulate points in the Bono app using their personal ID number, a unique QR code, or the QR/barcode found on a fiscal receipt or product.
4.2 To accumulate points via personal ID number, the user provides their ID number to the cashier of a partner company. The accumulated points are then reflected in the user’s account in the Bono app.
4.3 If the user is not registered in the app at the time of the transaction, the information related to their ID number and earned points will be stored, and once the user completes registration, the points will be credited to their account in the Bono app.
4.4 To accumulate points using a QR code, the user presents their unique QR code from the Bono app account to the cashier at a partner company. After scanning the QR code, the corresponding points will be added to the user’s account.
4.5 To accumulate points using the QR/barcode found on a fiscal receipt or product, the user scans the code in the Bono app, and the points will be credited to their account accordingly.
Article 5. Rules for Spending Points
5.1 Bono app users have the ability to spend their accumulated points. This can be done in several ways: spending points within the app, or at a partner merchant’s physical network or digital channel. Methods of spending include directly in the app, via personal ID number, QR/barcode, or a one-time code.
5.2 Spending points within the app involves exchanging accumulated points for corresponding products/services listed in the Bono app’s catalog.
5.3 If a user wishes to spend points via personal ID number, they express this desire to a partner company. The user’s personal ID number and a one-time code are used to verify whether they have sufficient points. If the required points are available, the points are spent according to the user’s request.
5.4 If a user wishes to spend points via QR/barcode:
a)The user expresses the desire to a partner company to spend accumulated points. The user then generates a dynamic QR/barcode within the app. After scanning or entering the corresponding Latin characters and digits of the barcode, the partner company’s representative or system checks whether the user has enough points. If so, the points are spent as per the user’s request.
b)The partner company’s representative or system generates a dynamic QR/barcode that corresponds to the user’s basket/order. The user scans this code using the app and confirms the payment within the app, which results in the points being spent accordingly.
Article 6. Electronic Wallet
6.1 The electronic wallet represents an electronic money account registered under the user’s name, as presented in the Bono app, which allows the use of electronic money in the manner defined by this agreement.
6.2 The electronic wallet belongs solely to the user of the Bono app. It is prohibited to transfer, assign, or pledge the electronic wallet.
6.3 The electronic wallet is registered for an indefinite period.
6.4 The electronic wallet has an electronic money account in one currency only – Georgian Lari (GEL) in all cases.
6.5 The electronic money in the wallet represents the nominal value of funds received by the provider from the user, stored in the electronic wallet, which the user can keep, withdraw, or use according to the rules defined by this agreement.
6.6 Electronic money remains in the wallet until the user withdraws or disposes of it.
6.7 Wallet Top-up via Bank Transfer: The user can top up the wallet via branches of commercial banks in Georgia or via internet banking. To top up, the user must specify the bank account number of LLC “Bono Pay,” indicate LLC “C Bono Pay” as the recipient, and include the wallet owner’s full name and personal ID number in the payment purpose.
6.8 Wallet Top-up via Open Banking: The user has the right to link their accounts in partner bank(s) to the Bono app, allowing for top-ups. Linking will occur through confirmation within the partner bank’s internet banking system.
6.9 If the user deposits funds via a bank account, the funds will be credited to the user’s account according to banking business hours.
6.10 Upon registering in the Bono app, an electronic wallet will be created under the user’s name (hereinafter “Electronic Wallet”), giving the user access to the wallet and its functionalities.
6.11 The user has the right to:
a)Store electronic money in the wallet for an unlimited time;
b)Withdraw cash from Bono Pay’s office;
c)If electronic money exists in the wallet and a payment order is confirmed by the provider, print the payment order and receive or issue cash at the cashier;
d)In the event of a withdrawal request, and upon provider confirmation, withdraw cash from the cashier using the funds from the wallet.
6.12 Bono Pay has the right to block or suspend the electronic wallet and the user’s access at any time if:
a)There is a reasonable suspicion that the user is using the payment service or wallet for money laundering purposes;
b)It is discovered that user identification was improperly performed before the agreement was signed;
c)It is discovered that the user is attempting to withdraw or spend unauthorized funds that appeared due to a system error and do not belong to them.
Article 7. Important Information
7.1 The amount of points accumulated may vary across different partner companies and may change at any time.
7.2 Any terms promised to the user by a partner company do not imply that these terms are established by the main company. Therefore, the company does not take responsibility for such conditions.
7.3 If a registered user changes their mobile phone number, they must request an update in the system as soon as possible to continue collecting and spending points without interruption in the Bono app.
7.4 If an unregistered user changes their mobile device, any collected points and information will be lost. However, a registered user can access their account on the app using their registration credentials even after changing their mobile device.
7.5 Since the user accumulates and spends points through the Bono app, which consolidates points collected at various locations, a negative balance may arise in the user’s account. In such cases:
a)The company has the right to offset the negative balance using the balance accumulated at the user’s partner companies;
b)In the case of a negative balance on the electronic wallet account, the company holds the same authority as described in subparagraph “a” of this clause;
c)If the company is unable to offset the user’s negative balance, it has the right to request repayment of the debt within one month. If the user fails to do so, the debt may be collected from their personal bank account via open banking, without the user’s additional consent.
Article 8. Privacy
8.1 By entering into this agreement, the user consents to the collection of their personal data in the application’s database. The data may be cross-referenced with databases of partner companies, and if a match is found, the corresponding data from the partner company will be reflected in the application.
8.2 The company undertakes to ensure the protection of the user’s personal data. The data will not be transferred or shared with non-partner companies or third parties.
8.3 If the user requests the deletion of their personal account and termination of this agreement, the personal data accumulated during the term of the agreement will be archived and not used for operational purposes, but only for statistical analysis.
Article 9. Unilateral Termination of the Agreement by the Company
9.1 If the user fails to comply with these terms and conditions, deliberately provides false information to the company, and/or misuses the application, the company is authorized to unilaterally terminate the agreement.
9.2 The company is also authorized to unilaterally terminate the agreement in other cases as provided by the applicable laws of Georgia.
